Tenancy For ALL Or Tenancy For THE RICH?

On 21st February, 2020, the 3 trustees – Armaity Tirandaz, XerxesDastur and Viraf Mehta – passed a Resolution regarding the conversion of Leave & License to Tenancy. The following is an excerpt taken from the Resolution as regards community members being allowed to convert from L&L to Tenancy…

“…by following the legal process to be prescribed including payment of stamp duty, registration and their statutory charges as also the consent to convert the interest free refundable security deposit into a deemed donation to the Trust, and upon the valid exercise of such option, such licensee will become a monthly contractual tenant of the Trust, subject to completion of legal, tax and audit formalities.”

IT IS THEREFORE VERY CLEAR, THAT THIS WAS JUST FOR THOSE WHO HAVE A REFUNDABLE SECURITY DEPOSIT… AND FOR NO ONE ELSE. ONLY THOSE WHO HAVE GIVEN DEPOSITS WILL HAVE TO GIVE THEIR CONSENT TO CONVERT THEIR DEPOSITS INTO DONATIONS, AND ONCE SUCH CONSENT IS GIVEN, THEY WILL THEN BE MADE TENANTS.

The following is an excerpt taken from Trustee Kersi Randeria’s response to this Resolution, in his email, dated 21st March, 2022:

“1. After completing the conditions recorded in the resolution passed by the three Trustees (conditions underlined for identification) in the Board meeting of 21-2-2022, the Trustees resolve to first consider the poor and middle class Parsi and Irani beneficiaries (and NOT THE RICH AND THE ULTRA RICH) for availing the benefits of any such policy by BPP PAYING THE STAMP DUTY AND REGISTRATION CHARGES FOR AND ON BEHALF OF OUR LESS FORTUNATE BENEFICIARIES AND ONLY AFTER THAT CONSIDER THE MORE AFFLUENT MEMBERS OF THE COMMUNITY (INCLUDING THEIR FRIENDS AND FAMILY MEMBERS) for tenancy.”

We hope this clears any confusion amongst community members as regards the Tenancy issue and which Trustee is in fact, standing for the poor and the middle-class of our community.

Also, all residents of Wadia Colonies are informed that Mr. Nusli Wadia has said, as regards the L&L to Tenancy Conversion, that not only WILL HE NOT ALLOW THE CONVERSION, BUT IF THE CONVERSION DOES TAKE PLACE, HE WILL CONSIDER OPTIONS TO REVERSE THIS POLICY POST ELECTIONS.
